An iden\u00adti\u00adfi\u00adab\u00adle natu\u00adral per\u00adson is one who can be iden\u00adti\u00adfi\u00aded, directly or indi\u00adrectly, in par\u00adti\u00adcu\u00adlar by refe\u00adren\u00adce to an iden\u00adti\u00adfi\u00ader such as a name, a num\u00adber, loca\u00adti\u00adon data, an online iden\u00adti\u00adfi\u00ader or to one or more fac\u00adtors spe\u00adci\u00adfic to the phy\u00adsi\u00adcal, phy\u00adsi\u00ado\u00adlog\u00adi\u00adcal, gene\u00adtic, men\u00adtal, eco\u00adno\u00admic, cul\u00adt\u00adu\u00adral or soci\u00adal iden\u00adtity of that natu\u00adral per\u00adson.<\/span><\/p>\n

Data pro\u00adces\u00adsing: any ope\u00adra\u00adti\u00adon or set of ope\u00adra\u00adtions which is per\u00adfor\u00admed on per\u00adso\u00adnal data or data files, whet\u00adher or not by auto\u00adma\u00adted means, such as coll\u00adec\u00adti\u00adon, record\u00ading, orga\u00adni\u00adsa\u00adti\u00adon, struc\u00adtu\u00adring, stor\u00adage, adap\u00adta\u00adti\u00adon or alte\u00adra\u00adti\u00adon, ret\u00adri\u00ade\u00adval, con\u00adsul\u00adta\u00adti\u00adon, use, disc\u00adlos\u00adure by trans\u00admis\u00adsi\u00adon, dis\u00adse\u00admi\u00adna\u00adti\u00adon or other\u00adwi\u00adse mak\u00ading ava\u00adi\u00adlab\u00adle, align\u00adment or com\u00adbi\u00adna\u00adti\u00adon, rest\u00adric\u00adti\u00adon or destruc\u00adti\u00adon.<\/span><\/p>\n

Data cont\u00adrol\u00adler: the natu\u00adral or leg\u00adal per\u00adson, pub\u00adlic aut\u00adho\u00adrity, agency or any other body which, alo\u00adne or jointly with others, deter\u00admi\u00adnes the pur\u00adpos\u00ades and means of the pro\u00adces\u00adsing of per\u00adso\u00adnal data.<\/span><\/p>\n

Data pro\u00adces\u00adsor: the natu\u00adral or leg\u00adal per\u00adson, pub\u00adlic aut\u00adho\u00adrity, agency or any other body which pro\u00adces\u00adses per\u00adso\u00adnal data on behalf of the data cont\u00adrol\u00adler.<\/span><\/p>\n

Joint data cont\u00adrol\u00adlers: if the pur\u00adpos\u00ades and means of data pro\u00adces\u00adsing are deter\u00admi\u00adned jointly by two or more data cont\u00adrol\u00adlers, they are cons\u00adidered joint data cont\u00adrol\u00adlers.<\/span><\/p>\n

Third par\u00adty: a natu\u00adral or leg\u00adal per\u00adson, pub\u00adlic aut\u00adho\u00adrity, agency or any other body other than the data sub\u00adject, the cont\u00adrol\u00adler, the pro\u00adces\u00adsor or the per\u00adsons who, under the direct cont\u00adrol of the cont\u00adrol\u00adler or pro\u00adces\u00adsor, are aut\u00adho\u00adri\u00adsed to pro\u00adcess per\u00adso\u00adnal data.<\/span><\/p>\n

Data pro\u00adtec\u00adti\u00adon inci\u00addent: a bre\u00adach of secu\u00adrity that results in the acci\u00adden\u00adtal or unlaw\u00adful destruc\u00adti\u00adon, loss, alte\u00adra\u00adti\u00adon, una\u00adut\u00adho\u00adri\u00adzed disc\u00adlos\u00adure of, or una\u00adut\u00adho\u00adri\u00adzed access to, per\u00adso\u00adnal data trans\u00admit\u00adted, stor\u00aded, or other\u00adwi\u00adse pro\u00adces\u00adsed.<\/span><\/p>\n

Law\u00adful data pro\u00adces\u00adsing by the data cont\u00adrol\u00adler:<\/span><\/p>\n

The data cont\u00adrol\u00adler pro\u00adces\u00adses per\u00adso\u00adnal data only in the fol\u00adlo\u00adwing cas\u00ades:<\/span><\/p>\n

if the data sub\u00adject has given con\u00adsent to the pro\u00adces\u00adsing of his or her per\u00adso\u00adnal data for one or more spe\u00adci\u00adfic pur\u00adpos\u00ades,<\/span><\/p>\n

the data pro\u00adces\u00adsing is neces\u00adsary for the per\u00adfor\u00admance of a cont\u00adract to which the data sub\u00adject is a par\u00adty,<\/span><\/p>\n

the data pro\u00adces\u00adsing is neces\u00adsary for the ful\u00adfill\u00adment of a leg\u00adal obli\u00adga\u00adti\u00adon to which the data cont\u00adrol\u00adler is sub\u00adject,<\/span><\/p>\n

the pro\u00adces\u00adsing is neces\u00adsary to pro\u00adtect the vital inte\u00adrests of the data sub\u00adject or anot\u00adher natu\u00adral per\u00adson,<\/span><\/p>\n

the data pro\u00adces\u00adsing is neces\u00adsary for the pur\u00adpos\u00ades of the legi\u00adti\u00adma\u00adte inte\u00adrests of the data cont\u00adrol\u00adler or a third par\u00adty.<\/span><\/p>\n

The data cont\u00adrol\u00adler exa\u00admi\u00adnes the law\u00adful\u00adness of data pro\u00adces\u00adsing at every stage of its acti\u00advity and only pro\u00adces\u00adses data for as long as it can jus\u00adti\u00adfy its pur\u00adpo\u00adse and leg\u00adal basis. If the con\u00addi\u00adtions for a leg\u00adal basis cea\u00adse to exist, data pro\u00adces\u00adsing can only be con\u00adti\u00adnu\u00aded if the data cont\u00adrol\u00adler can jus\u00adti\u00adfy anot\u00adher app\u00adrop\u00adria\u00adte leg\u00adal basis.<\/span><\/p>\n

The main rule for pro\u00adving leg\u00adal grounds is that they must be in writing. Even in the case of a leg\u00adal ground est\u00adab\u00adlis\u00adhed by induc\u00adtive con\u00adduct, it must be exa\u00admi\u00adned whet\u00adher it can be cle\u00adarly pro\u00adven after\u00adwards. In case of doubt, with regard to the aspects of rea\u00adson\u00adab\u00adle\u00adness and eco\u00adnomy, eff\u00adorts sho\u00aduld be made to con\u00adfirm in writing the data pro\u00adces\u00adsing est\u00adab\u00adlis\u00adhed by induc\u00adtive con\u00adduct.<\/span><\/p>\n

In the case of data pro\u00adces\u00adsing bas\u00aded on con\u00adsent, the data sub\u00adject gives writ\u00adten con\u00adsent to the pro\u00adces\u00adsing of his or her per\u00adso\u00adnal data. Con\u00adsent is not sub\u00adject to for\u00admal requ\u00adi\u00adre\u00adments, but sub\u00adse\u00adqu\u00adent pro\u00adva\u00adbi\u00adlity requ\u00adi\u00adres writ\u00adten con\u00adsent on paper or electro\u00adni\u00adcally.<\/span><\/p>\n

Data pro\u00adces\u00adsing bas\u00aded on the leg\u00adal basis of ful\u00adfil\u00adling a leg\u00adal obli\u00adga\u00adti\u00adon is inde\u00adpen\u00addent of the con\u00adsent of the data sub\u00adject, as data pro\u00adces\u00adsing is deter\u00admi\u00adned by law.<\/span><\/p>\n

Regard\u00adless of the man\u00adda\u00adto\u00adry natu\u00adre of data pro\u00adces\u00adsing, the indi\u00advi\u00addu\u00adal con\u00adcer\u00adned must be infor\u00admed befo\u00adre the start of data pro\u00adces\u00adsing that the data pro\u00adces\u00adsing is man\u00adda\u00adto\u00adry and can\u00adnot be avo\u00adid\u00aded, and the indi\u00advi\u00addu\u00adal con\u00adcer\u00adned must be pro\u00advi\u00added with clear and detai\u00adled infor\u00adma\u00adti\u00adon abo\u00adut all sig\u00adni\u00adfi\u00adcant facts rela\u00adted to the pro\u00adces\u00adsing of his or her data befo\u00adre the start of data pro\u00adces\u00adsing.<\/span><\/p>\n

Accord\u00ading to the GDPR (Gene\u00adral Data Pro\u00adtec\u00adti\u00adon Regu\u00adla\u00adti\u00adon), per\u00adso\u00adnal data may also be pro\u00adces\u00adsed if the pro\u00adces\u00adsing is neces\u00adsary for the per\u00adfor\u00admance of a cont\u00adract to which the indi\u00advi\u00addu\u00adal con\u00adcer\u00adned is a par\u00adty, or if the pro\u00adces\u00adsing or coll\u00adec\u00adti\u00adon of data is neces\u00adsary to take steps at the request of the indi\u00advi\u00addu\u00adal con\u00adcer\u00adned pri\u00ador to enter\u00ading into a cont\u00adract. The cont\u00adrol\u00adler may pro\u00adcess per\u00adso\u00adnal data for the pur\u00adpo\u00adse of conc\u00adlu\u00adding, per\u00adform\u00ading or ter\u00admi\u00adnat\u00ading the cont\u00adract on the leg\u00adal basis of per\u00adfor\u00admance of the cont\u00adract.<\/span><\/p>\n

PROCESSING OF PERSONAL DATA BY THE DATA CONTROLLER<\/strong><\/span><\/p>\n

The data cont\u00adrol\u00adler is a leg\u00adal entity pri\u00adma\u00adrily engag\u00aded in the pro\u00adduc\u00adti\u00adon and dis\u00adt\u00adri\u00adbu\u00adti\u00adon of mic\u00adro\u00adbio\u00adlog\u00adi\u00adcal pro\u00adducts. In the cour\u00adse of car\u00adrying out the\u00adse acti\u00advi\u00adti\u00ades, it may come into con\u00adtact with the per\u00adso\u00adnal data of natu\u00adral per\u00adsons. The data cont\u00adrol\u00adler car\u00adri\u00ades out the fol\u00adlo\u00adwing data pro\u00adces\u00adsing acti\u00advi\u00adti\u00ades:<\/span><\/p>\n

The data cont\u00adrol\u00adler\u2019s cont\u00adrac\u00adtu\u00adal part\u00adners in its manu\u00adfac\u00adtu\u00adring, dis\u00adt\u00adri\u00adbu\u00adti\u00adon and con\u00adsult\u00ading ser\u00advi\u00adce acti\u00advi\u00adti\u00ades and in its coope\u00adra\u00adti\u00adon with resel\u00adler part\u00adners, cus\u00adto\u00admers and regi\u00ado\u00adnal rep\u00adre\u00ads\u00aden\u00adta\u00adti\u00adves may be both pri\u00advate indi\u00advi\u00addu\u00adals and leg\u00adal enti\u00adti\u00ades.<\/span><\/p>\n

The conc\u00adlu\u00adsi\u00adon of the cont\u00adract is pre\u00adce\u00added by a request for a quo\u00adte in the form of an e\u2011mail mes\u00adsage using the con\u00adtact form on the cont\u00adrol\u00adler\u2019s web\u00adsite ( soluzioninaturali.eu ). The cli\u00adent pro\u00advi\u00addes his\/her name, telep\u00adho\u00adne num\u00adber, e\u2011mail add\u00adress, to which the cont\u00adrol\u00adler sends the rele\u00advant quo\u00adte. If the quo\u00adte is rejec\u00adted, the data sub\u00adject\u2019s per\u00adso\u00adnal data will be dele\u00adted imme\u00addia\u00adtely, but no later than wit\u00adhin 3 wor\u00adking days. The leg\u00adal basis for the pro\u00adces\u00adsing of per\u00adso\u00adnal data is the conc\u00adlu\u00adsi\u00adon of the cont\u00adract (Artic\u00adle 6(1)(b) of the Gene\u00adral Data Pro\u00adtec\u00adti\u00adon Regu\u00adla\u00adti\u00adon). If the data sub\u00adject orders the offe\u00adred ser\u00advi\u00adce, a cont\u00adract will be conc\u00adlu\u00added. Upon conc\u00adlu\u00adsi\u00adon of the cont\u00adract, the cont\u00adrol\u00adler will acqu\u00adi\u00adre addi\u00adti\u00ado\u00adnal per\u00adso\u00adnal data of indi\u00advi\u00addu\u00adals (part\u00adners, rep\u00adre\u00ads\u00aden\u00adta\u00adti\u00adves and con\u00adtact per\u00adsons). The leg\u00adal basis for data pro\u00adces\u00adsing is the ful\u00adfill\u00adment of the obli\u00adga\u00adti\u00adon assum\u00aded in the cont\u00adract (Artic\u00adle 6(1)(b) of the Gene\u00adral Data Pro\u00adtec\u00adti\u00adon Regu\u00adla\u00adti\u00adon), in the case of a con\u00adtact per\u00adson of a leg\u00adal per\u00adson, the con\u00adsent of the data sub\u00adject (Artic\u00adle 6(1)(a) of the Gene\u00adral Data Pro\u00adtec\u00adti\u00adon Regu\u00adla\u00adti\u00adon). The data cont\u00adrol\u00adler issues an invo\u00adi\u00adce for the cons\u00adide\u00adra\u00adti\u00adon of the cont\u00adrac\u00adtu\u00adal ser\u00advi\u00adce pro\u00advi\u00added by it, depend\u00ading on the ser\u00advi\u00adce pro\u00advi\u00added. The invo\u00adi\u00adce con\u00adta\u00adins the name, add\u00adress and pos\u00adsibly the tax num\u00adber of the cus\u00adto\u00admer. Issu\u00ading the invo\u00adi\u00adce is the obli\u00adga\u00adti\u00adon of the data cont\u00adrol\u00adler set out in the law. The leg\u00adal basis for the pro\u00adces\u00adsing of per\u00adso\u00adnal data inc\u00adlu\u00added in the invo\u00adi\u00adce is the ful\u00adfill\u00adment of a leg\u00adal obli\u00adga\u00adti\u00adon (Artic\u00adle 6(1)\u00a9 of the Gene\u00adral Data Pro\u00adtec\u00adti\u00adon Regu\u00adla\u00adti\u00adon). The data cont\u00adrol\u00adler stores the per\u00adso\u00adnal data inc\u00adlu\u00added in the invo\u00adi\u00adce for 8 years, in comp\u00adli\u00adance with the retent\u00adion obli\u00adga\u00adti\u00adon set out in Sec\u00adti\u00adon 169 of the Account\u00ading Act.<\/span><\/p>\n

You can apply for pro\u00adfes\u00adsi\u00ado\u00adnal advi\u00adce ava\u00adi\u00adlab\u00adle on the data cont\u00adrol\u00adler\u2019s web\u00adsite at the data cont\u00adrol\u00adler\u2019s e\u2011mail add\u00adress pro\u00advi\u00added in this infor\u00adma\u00adti\u00adon. When apply\u00ading, the data cont\u00adrol\u00adler asks for the cli\u00adent\u2019s name, e\u2011mail add\u00adress and telep\u00adho\u00adne num\u00adber.
